Terms of Sale

These Terms of Sale apply to orders placed with [INSERT LEGAL BUSINESS NAME], trading as Desqpad, through desqpad.com or another sales channel that links to these Terms. By submitting an order, you agree to these Terms. Please read them before purchasing.

Scope: Desqpad currently accepts orders for delivery within Pakistan only. We do not undertake international sales or delivery under these Terms.

1. Eligibility and customer information

You must be at least 18 years old and legally capable of entering into a contract. You must provide accurate, complete and current contact, payment and delivery information. You are responsible for checking the product, colour, quantity, price, address and telephone number before submitting the order.

2. Order process and acceptance

An order confirmation or automated message acknowledges that we received your order; it does not necessarily mean the order has been accepted. A binding sale is formed when we confirm acceptance or dispatch the product, whichever occurs first. We may contact you by telephone or WhatsApp to verify a cash-on-delivery order.

Before acceptance, we may reject or cancel an order for legitimate reasons, including unavailability, an obvious pricing or description error, failed payment, inability to verify delivery details, suspected fraud, repeated refusal of deliveries, abuse of promotions or a delivery location that our courier cannot serve. If payment has already been collected for a cancelled order, it will be refunded through an available method.

3. Products and descriptions

We take reasonable care to present product information accurately. Screen settings, lighting and photography can cause minor differences in colour. Measurements may vary slightly within normal manufacturing tolerances. A minor variation that does not materially affect function or correspond to a defect does not by itself make the product faulty.

Product packaging, included accessories and non-essential design details may change where the replacement is of equivalent or better function and quality. We will not substitute a materially different product without your agreement.

4. Prices, taxes and delivery charges

Prices are shown in Pakistani rupees (PKR). Applicable taxes and delivery charges will be included in the displayed price or shown before order submission, as relevant. We may change prices prospectively at any time. A price change does not affect an order already accepted, except where the displayed price was an obvious error that a reasonable customer would recognise.

Discount codes and promotions are subject to their stated conditions, availability and validity period. Unless expressly stated otherwise, promotions cannot be combined, exchanged for cash or applied retrospectively.

5. Payment

Available payment methods are displayed at checkout and may include cash on delivery, bank transfer, card, wallet or another electronic method. Payment is subject to verification by the relevant provider. You must use a payment method you are authorised to use.

For cash on delivery, payment is due to the authorised courier at delivery. We may require confirmation before dispatch and may limit or disable cash on delivery for high-value, repeated, suspicious or previously refused orders, where permitted by law.

6. Delivery

Delivery estimates are estimates, not guaranteed deadlines, unless we expressly agree otherwise in writing. Delays may arise from courier operations, weather, public holidays, security conditions, address problems, service interruptions or events beyond reasonable control. We will take reasonable steps to communicate material delays known to us.

You must ensure that an authorised person is available to receive the parcel and that the courier can safely access the delivery location. If delivery fails because the address or contact information is incorrect, the recipient is unavailable, or delivery is refused without a valid reason, we may cancel the order and recover reasonable re-delivery or return-to-origin costs where lawful.

Risk of loss or accidental damage passes to you when the product is delivered to you or a person authorised by you. Ownership passes when we have received full payment.

7. Inspection on delivery

The Desqpad includes a glass surface and should be handled carefully. Inspect the outer parcel for visible damage before accepting it where the courier permits. After delivery, open and inspect the product carefully and report transit damage, missing items or an incorrect product promptly under the Refund, Return and Replacement Policy.

Photographs of the parcel, shipping label, packaging and product help us investigate a claim. An unboxing video is useful but is not an absolute condition where other reasonable evidence establishes the issue or applicable law provides otherwise.

8. Cancellations, returns and refunds

Cancellations, returns, replacements and refunds are governed by our Refund, Return and Replacement Policy, which forms part of these Terms. Nothing in either document limits a mandatory remedy available under applicable consumer law.

9. Safe use and care

Place the product on a stable, level surface and keep it away from unsupported edges.

Do not sit, stand or place excessive weight on the glass surface or storage compartment.

Do not use a cracked, chipped or structurally damaged glass product. Keep fragments away from children and dispose of damaged glass safely.

Use suitable markers and cleaning materials in accordance with the product instructions. Test third-party cleaners on a small area and avoid abrasive pads, blades, harsh chemicals and impacts.

Keep small accessories and cleaning products away from children and use any cleaner in accordance with its label.

Damage caused by misuse, impact, improper assembly or placement, unauthorised modification, unsuitable cleaning materials, ordinary wear or failure to follow care instructions is not a manufacturing defect, subject always to applicable law.

10. Intellectual property

Desqpad names, branding, product photographs, website copy, graphics and other content are owned by or licensed to us. Purchasing a product does not transfer any intellectual-property rights. Content may not be copied, reproduced or used commercially without prior written permission, except as allowed by law.

11. Liability

We do not exclude or restrict liability that cannot lawfully be excluded, including liability arising from fraud, wilful misconduct, or any mandatory consumer remedy. Subject to that rule, Desqpad is not liable for indirect or consequential loss, loss of profit, loss of business, or loss caused by misuse, unauthorised alteration or failure to follow safety and care instructions.

Where liability can lawfully be limited, our aggregate liability arising from a particular order will not exceed the amount paid for that order. This limitation does not reduce any remedy that applicable consumer law requires us to provide.

12. Events beyond reasonable control

We are not responsible for delay or failure caused by an event beyond our reasonable control, including natural disaster, severe weather, epidemic, civil disturbance, government action, transport disruption, telecommunications failure, labour interruption or widespread courier disruption. We will take reasonable steps to reduce the effect and resume performance.

13. Governing law and disputes

These Terms are governed by the laws of Pakistan. Applicable federal, provincial and Islamabad Capital Territory consumer laws remain in force according to their scope. The parties should first attempt to resolve a complaint through Desqpad customer support. If it remains unresolved, either party may use any court, consumer court, authority or other forum having lawful jurisdiction. Nothing in these Terms deprives a consumer of a forum or remedy that cannot legally be waived.

14. General terms

If any provision is held unlawful or unenforceable, it will be limited or removed only to the minimum extent necessary and the remaining provisions will continue. A delay in enforcing a right is not a waiver. We may update these Terms prospectively by posting a revised version; the Terms applicable when an order is accepted will normally govern that order unless a legal change requires otherwise. You may not transfer an order or rights under it without our consent, except where law permits.
